What is the amount of support that the non-custodial parent should provide?

Should they pay child support and also the mortgage on the house and other expenses?

A very common issue is defining the financial contribution of parents to their children, commonly known as child support. At FDR, we advise and represent our clients to obtain in court the establishment of fair child support, taking into account the actual expenses of the children, as well as the income of both parents.

Successions

The loss of a loved one constitutes one of the most difficult moments that all families go through. But it is always necessary to consider that, in addition to everything related to funerals and the grief caused by the loss, there is also the need to resolve the legal issues arising from the death, such as defining the deceased’s estate.

What happens to the assets that were in the deceased’s name? The house, car, bank accounts, and any other asset? This situation must be resolved through a succession process before the civil jurisdiction, which will depend on whether the deceased left a will or not.

In both cases, the purpose of the succession process is to determine who the Law recognizes as heirs or legatees of those assets and to precisely define the scope of that inheritance.

Thus, there are two types of processes to solve the deceased’s estate situation:

  • Testate Succession Process or Trial, when there is a will; and,
  • Intestate Succession Process or Trial, when there is no will.

These processes are not under the jurisdiction of the Family Court but are under the jurisdiction of the Civil Court. However, we include them in our area of family legal services due to the intimate nature of these matters.
